Article 10 – Family protection

1. The family will be subject to special protection whether its members have decided to live under a heterosexual, homosexual, or any other family structure .

2. Bigamy and polygamy remain prohibited by law, as they infringe upon the dignity of the person.

3. Public authorities shall foster reconciliation between family and professional life, by means of policies aimed at protecting income level when taking care of minors.

4. The State shall encourage the equitable sharing of housework between all family members, regardless of gender.

Article 9 – Protection of private life

1. Any person has a right to the respect for his privacy and family life, without any public or private interference, which includes the inviolability of the home, postal , telematic or online correspondence.

2. No entry or search into a dwelling may be carried out without the owner’s explicit consent or a reasoned order, except for emergency situations of flagrante delicto.

Article 8 – Human dignity and integrity

1. Life is inviolable. The death penalty is expressly prohibited.

2. No one shall be subjected to torture or degrading treatment with contempt to one’s dignity as a human being.

3. Every human being has the right to personal freedom, physical and mental integrity, and to choose one’s place of residence.

4. The State shall ensure that every person in need or at risk of social exclusion enjoys a minimum guaranteed income that will allow him/her a dignified life.

Article 7 – Equality

1. No one will be discriminated on grounds of sex, race, origin, religious beliefs or political opinions, physical and/or mental disability, language, sexual orientation or any other personal, social or cultural condition.

2. The legal granting of immunity is considered an unacceptable privilege in a democratic state of law, hence, it is hereby stated that all persons are equal before the law, without distinction of any kind.

3. Men and women are entitled to equal pay for equal work.

4. The State ensures the fundamental principle of equal opportunities for men and women, with special emphasis on education, employment and access to positions of responsibility in public life.

Article 6 – Human Rights

1. The law of the Catalan Republic will always be interpreted in accordance with the inspiring principles of the Charter of the United Nations, the Universal Declaration of Human Rights, the International Covenant on Civil and Political Rights, the International Covenant on Social Economic and Cultural Rights, and the European Convention on Human Rights.

Article 5 – The Capital

1. Barcelona is the capital of Catalonia.

2. Barcelona is the seat of government of the Republic, the Parliament, the Supreme Court, and the executive, legislative and judiciary powers.

3. The state administration is characterized by the principles of proximity and decentralization; consequently, the Council of Ministers will meet in plenary session at least once a year in the cities of Girona, Lleida and Tarragona.

Article 4 – The language

1. The official language of Catalonia is the Catalan, and shall therefore be preferentially used by all public administrations in their respective areas of competence.

2. Given Catalonia’s present demographic and social situation, and with the explicit aim of ensuring the best possible coexistence among all Catalans, whatever their origin, the Spanish language enjoys the status of a co-official language, and may be used orally and in writing by all citizens who wish to do so.

3. Aranese is the official and own language of the Aran Valley, and Aranese is fully co-official with the Catalan.

4. Public authorities will ensure non-discrimination on the grounds of language, as all languages deserve the same respect and are part of everyone’s personal and free choice.

5. We herein declare that language and culture favours internal cohesion, common prosperity, social embeddedness and diversity in the country.

Article 3 – Symbols

1. The flag of Catalonia will remain the historic four red stripes on a yellow background.

2. The official anthem of Catalonia is ‘Els Segadors’.

3. The 11th of September will be designated Catalonia’s National Day.

Article 2 – The Catalan State

1. The political and legal form of organization of the State is the unicameral parliamentary republic and not a presidential republic.

2. In order to fight against social injustice, poverty, violent conflicts, economic inequality, environmental degradation and corruption, the governing principles of the legal status of the Catalan republic are: freedom, justice, equal rights and obligations, culture, solidarity, human rights, diversity and peace.
