Article 31 – Duty to contribute to public expenditure

1. All individuals and legal entities are obliged to contribute to the sustainability of public spending within the framework of a fair and proportional tax system.

2. The Taxation Agency of Catalonia will guarantee the principle of equality in indirect taxation and of proportionality in direct taxation.

Article 30 – Right to protection in case of illness and Social Security

1. All persons are entitled to free health care in case of emergency regardless of their administrative status or employment.

2. Social Security benefits will be guaranteed in an equitable and proportional manner to all citizens who have contributed to the support of the public system over the course of their lifetime. The law will set the minimum and maximum annual quantities, which can never be less than the basic income for decent standard of livin.

Article 29 – Right to work

1. Everyone has the right to work in decent conditions, have appropriate safety measures adopted to prevent occupational risks of accidents and receive fair wages.

2. Trade union organizations will ensure compliance with the rights guaranteed in collective agreements, and be ligitimally empowered to raise complaints before the labour courts.

Article 27 – Presumption of innocence and judicial protection

1. Any citizen can lodge a writ of ‘amparo’ claiming effective remedy before the Constitutional Chamber of the Supreme Court of Guarantees of the Republic, after ordinary jurisdictional instances have been exhausted.

2. Every person is entitled to the presumption of innocence, to have the ordinary judge predetermined by law, to the defence and legal assistance of a lawyer, to be informed of the charges, to have the right not to testify against oneself, to a public process in a reasonable period of time, and to present relevant evidence for his defense.

Article 28 – The right to private property and dignified housing

1. The right to private property, without prejudice to require its rightful owner, the fulfillment of the duties which are inseparable to the social function.

2. In case of public interest, Administrations may expropriate or restrict the right to ownership and use, without prejudice to the corresponding financial compensation.

3. Everybody has the right to decent housing. All public authorities remain bound to make available a minimum percentage of social rental apartments -equivalent to 10% of apartments built in each municipality- to citizens who experience poverty and risk of social exclusion.

Article 25 – Tutelage before the Administration

1. Citizens have the right to raise petitions and complaints before the Ombudsman and/or the Local Ombudsman which must be answered within 30 days.

2. Municipalities of over 10,000 inhabitants must have the corresponding Ombudsman who will defend the rights of citizens before the Municipal Administration.

Article 24 – Right to Revocation of Elected Authorities

1. Electoral mandates will be limited to two terms of office. Elected representatives will not be re-submitted until a minimum 10-years term has expired.

2. Constituents may request competent courts, the holding of a recall referendum for mayors, councilors and Members of Parliament (MPs) who systematically violate their electoral programme.

3. The filing of the lawsuit must be endorsed with the signature of at least 25 per cent of the voters from the voted list.

Article 23 – Right to Participatory Democracy and Transparency

1. Catalonia is a participatory democracy, where each and every citizen can feel part of the administration of public affairs and the common good.

2. The state administration is obliged to make all relevant data available to voters in relation to public spending, even at municipal level, and encourage collective participation -previous debate- in the decisions regarding priorities that must be reflected in the budgets.

3. Remuneration of all elected representatives shall be public. Their salary will be set annually by Parliament, and in any case will not exceed 10 times the amount of the basic income for a dignified life.

 

Article 22 – The right to participate in public affairs

1. All citizens have the right to participate in public affairs by exercising the democratic right to vote in elections, which to be held once every 5 years at the most.

2. The calling for elections and referendums, that will be free and universal, is the exclusive competence of Parliament.

3. All persons who have not been deprived of their civil and political rights, have the right to vote and/or to stand as a candidate.

4. All persons, associations and foundations may promote popular legislative initiatives. The law will determine the requirements and quorum necessary.

5. All citizens have the inalienable right to access to public functions and positions in equal opportunities.
